Il contributo propone una ricostruzione sistematica delle reazioni punitive dell’ordinamento all’illecito tributario (penali ed amministrative), approfondendo ed offrendo spunti innovativi alla categoria, affacciatasi recentemente nella dottrina, seppur non del tutto nuova, del diritto tributario punitivo; l’aggettivo “europeo” viene inserito per valorizzare l’influenza sistematica e caratterizzante dei principi elaborati dal diritto vivente sovranazionale (CEDU e Corte di Giustizia).
Viene riconosciuta l’esigenza di superare la diffusa “incertezza” del sistema tributario nel suo complesso, riecheggiata da recente dottrina, che sollecita una nuova collocazione sistematica dell’illecito tributario (e delle sanzioni), anche alla luce delle numerose e delicate questioni sollevate in sede interpretativa.
L’analisi propone anzitutto la ricostruzione della fattispecie, quindi dell’illecito, avendo cura anche di inquadrare nell’elaborazione le sanzioni “improprie”, al fine di apprezzare l’esigenza, nell’ottica di strutturare la materia alla luce dei principi di tutela del contribuente e di equilibrato contemperamento con il bene giuridico protetto, di un inquadramento unitario.
L’approccio innovativo non trascura alcuni snodi essenziali dell’evoluzione normativa né delle sanzioni amministrative, né di quelle penali, che vengono quindi proposti con approccio di ricostruzione (anche) storica, data l’importanza che ciò ha in una elaborazione scientifica attuale ma “consapevole” della materia.
Vengono, quindi, consapevolmente ripercorsi i passaggi essenziali, a partire dalla l. n. 4/1929, per arrivare infine all’attuale struttura delle fonti. L’indagine non dimentica i richiami alle questioni di attualità (ne bis in idem, Taricco), traendo da essi la legittimazione e la “giustificazione” dell’impegno per una innovativa ed originale ricostruzione organica della materia, nell’ambizioso scopo, richiamando il titolo dell’Opera di L.V. Berliri, di offrire un contributo per una “giusta” sanzione.
The article aim is to provide a systematic reenactment of the remedies providing the tax system to the tax tort (both criminal and administrative), deepening and offering innovative ideas to the category, which recently showed in the doctrine, albeit not entirely new, of “punitive” tax law; the adjective “European” is inserted to enhance the systematic and characterizing influence of the principles elaborated by the supranational Courts (ECHR and Court of Justice).
The need is recognized to overcome the widespread “uncertainty” of the tax system as a whole, echoed by recent doctrine, which calls for a new systematic collocation of the tax tort (as well as of penalties), also in the light of the new questions raised in the interpretation of the law.
The analysis first of all suggest the reconstruction of the case, therefore of the tort, also taking care to fine tune the “improper” penalties, in order to appreciate the need, in the light to provide principles of protection of the taxpayer and balanced with the protected legal asset, of a unique framework.
The innovative approach does not neglect the essential points of regulatory evolution, nor of administrative sanctions, nor of penal sanctions, which are therefore proposed with an (also) historical reconstruction approach, given the importance that this has in a current scientific elaboration with a strong “awareness” of the topic.
Therefore, the essential steps are consciously retraced, starting from Law no. 4/1929, to finally arrive at the current location of the sources. The investigation does not forget the references to current affairs (ne bis in idem, Taricco), drawing from them the legitimacy and the “justification” of the commitment for an innovative and original organic reconstruction of the topic, in the ambitious purpose, recalling the title of Berliri’s work, to suggest a view for a “fair” sanction.
