L’Autore illustra sinteticamente le principali caratteristiche dell’arbitrato societario nella riforma del 2003 e dell’arbitrato ordinario nella riforma del 2006. Segnala due gravi limiti dell’arbitrato societario: la questione della validità delle clausole compromissorie “vecchio stile” e il problema delle materie compromettibili. Formula alcune proposte di riforma sia per l’arbitrato societario sia per l’arbitrato ordinario come strumento facoltativo di deflazione della giurisdizione.
The Author briefly illustrates the main features both of commercial arbitration (after the Legislative Reform of 2003) and of ordinary arbitration (after the Legislative Reform of 2006). Moreover, he underlines two major shortcomings of commercial arbitration. First of all, the matter of law with respect to the legal soundness of “old-style” arbitration clauses; secondly, how it is possible to identify the subjects which cannot be legally settled by arbitration. Finally, the Author expresses some proposals of reform both of commercial arbitration and of ordinary arbitration, which is a discretionary instrument able to decrease the overabundance of trials.
